Benefits - Incapacity
What is it?
Incapacity Benefit is paid to people who are sick or disabled
and have been incapable of work before the 27/10/08, which are not
entitled to Statutory Sick Pay and are under State Pension Age.
Who is eligible?
You may be entitled to claim Incapacity, if the following apply
to you when you became sick:
- Your Statutory Sick pay has ended or you are not entitled
- You are self-employed or unemployed
- You have been getting Statutory Maternity Pay and have not
returned to work because you are incapable of work.
You must also have been:
- Paying National Insurance Contribution
- Unable to work due to sickness or disability for at least four
days in a row
- Unable to work for two or more days out of seven consecutive
days
- Getting special medical treatment
Or you must:
- Be aged between 16 and 20 (or 25 if you were in education or
training at
- least 3 months immediately before turning 20)
- Have been too ill to work because of sickness or disability for
at least 28 weeks
- Have been too ill to work before you turned 20 (or 25 if you
were in education or training at least 3 months immediately before
turning 20)
How much will I get?
Incapacity Benefit is paid at 3 weekly rates:
- Short-Term (Lower Rate) Incapacity Benefit is paid for the
first 28 weeks
- Under State Pension Age £68.95, Over State Pension Age
£87.75
- Short-Term (Higher Rate) Incapacity Benefit is paid from weeks
29 to 52
- Long-Term (Basic Rate) Incapacity Benefit
- Under Pension Age £91.40
- If you are over State Pension Age, you are not eligible for
long-term basic rate Incapacity Benefit.
